          Plain-English Summary: SpeedWatch is provided free of charge. Use it honestly, don't abuse it, don't reverse-engineer it, and understand that speed-test results may vary based on your device, network, and conditions. 1. Acceptance of Terms

By downloading, installing, or using the SpeedWatch Android application ("App") or visiting this website ("Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App or Site.

These Terms constitute a legally binding agreement between you ("User") and the developer of SpeedWatch ("we," "us," or "our"). We may update these Terms from time to time; continued use of the App or Site after any update constitutes acceptance of the revised Terms.

2. Description of Service

SpeedWatch is an Android application that provides:

Real-time internet speed testing (download, upload, latency, jitter)
Network health and connection type detection
Historical speed test logging and analytics
Technical lab diagnostics: ISP throttle detection, bufferbloat analysis, DNS resolution audit
Background monitoring and push notifications (optional)
Export of test history as PDF or CSV
An optional one-time Pro upgrade via Google Play in-app purchase

SpeedWatch is provided "as is." We reserve the right to modify, suspend, or discontinue any feature at any time without notice.

3. Eligibility

You must be at least 13 years old to use SpeedWatch. By using the App, you represent that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms.

4. Permitted Use

You may use SpeedWatch for lawful, personal, and non-commercial purposes. You agree that you will:

Use the App only on Android devices you own or are authorized to use
Comply with all applicable local, national, and international laws and regulations
Not use the App to interfere with, disrupt, or gain unauthorized access to any third-party networks, servers, or systems

5. Prohibited Conduct

You agree not to:

Reverse-engineer, decompile, disassemble, or attempt to derive the source code of the App
Modify, adapt, translate, or create derivative works based on the App
Use the App for any illegal purpose or in violation of any third-party rights
Circumvent, disable, or interfere with security features of the App
Use automated tools or bots to interact with the App in a way that generates excessive network traffic or abuses shared testing infrastructure
Misrepresent results obtained from the App (e.g., fabricating speed test screenshots for fraudulent purposes)

6. Accuracy of Speed Test Results

Speed test results provided by SpeedWatch are estimates based on measurements taken at a specific point in time and are subject to many factors outside our control, including:

Physical distance from test servers
Network congestion at the time of testing
Your device's hardware capabilities and background processes
Wi-Fi interference, signal strength, and router performance
Your ISP's network topology and peering arrangements

SpeedWatch results should be used as informational estimates only. We make no warranty that results accurately reflect your contracted ISP plan speed or your real-world performance for any specific application (streaming, gaming, browsing, etc.).

7. In-App Purchases (Pro Upgrade)

SpeedWatch offers a one-time Pro upgrade available through Google Play Billing. By purchasing Pro:

You authorize the charge to your Google Play payment method
All billing and payment processing is handled exclusively by Google Play; we do not store any payment information
Refunds are subject to Google Play's refund policy
Pro features are tied to your Google Play account and may be restored via the "Restore Purchase" option in Settings

8. Intellectual Property

SpeedWatch, including its name, logo, design, source code, and all content within the App and Site, is the exclusive intellectual property of the developer. All rights are reserved.

Nothing in these Terms grants you any right, title, or interest in SpeedWatch beyond the limited license to use the App on your personal Android device for the purposes described herein.

9. Third-Party Services

SpeedWatch integrates third-party services including Google AdMob (free tier), Firebase Crashlytics, Firebase Analytics, and Google Play Billing. Your use of the App is also subject to the terms and policies of these third parties:

10. Disclaimer of Warranties

THE APP AND SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES INCLUDING, WITHOUT LIMITATION:

Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
That the App will be uninterrupted, error-free, or free of viruses or other harmful components
That speed test results will be accurate, complete, or suitable for any specific purpose

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE SPEEDWATCH, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability is limited to the greatest extent permitted by law. Our total cumulative liability to you for any claim arising from your use of SpeedWatch shall not exceed the amount you paid for the Pro upgrade (if any) in the twelve months preceding the claim.

12. Indemnification

You agree to indemnify, defend, and hold harmless SpeedWatch's developer and any affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

Your access to or use of the App or Site
Your violation of these Terms
Your violation of any third-party rights

13. Termination

We reserve the right to discontinue the App or terminate your access at any time, with or without cause, with or without notice. Upon termination, all provisions of these Terms which by their nature should survive termination shall survive, including intellectual property provisions, warranty disclaimers, indemnity, and limitations of liability.

You may terminate your use of the App at any time by uninstalling it from your device.

14. Governing Law

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts in the developer's jurisdiction.

15. Changes to These Terms

We may modify these Terms at any time. When we do, we will update the "Last updated" date at the top of this page. If changes are material, we will make reasonable efforts to notify you (e.g., via an in-app notice). Your continued use of SpeedWatch after any change constitutes acceptance of the new Terms.
